No, I don't get that close when taking any offseason pictures unless I have permission from the park to do so.
Jason - many of your pictures look as though you might have been trespassing, I sure hope that was not the case. Be careful!
The road that used to go past the entrance is not blocked off from public traffic until you hit about 150 feet in.
If there was such concern for trespassing, I don't think it'd be on the outside of the park. I may be getting old, but walking around a fenced in area on a road doesn't make me think the cops are going to chase me down.

I have never and will never tresspass when taking any of my pictures. I've gotten my pano's simply by sticking my hand through the fence and rotating the camrea.
Also, to clarify, the other people i saw were on the other side of Rt. 43 when we walked pased each other.

I never suggested that anyone was jumping the fence, merely that some of the pictures looked to be awfully close. I guess I good zoom could do that. But he did say that he stuck his hand through the fence, isn't that trespassing?

Actually I am not kidding! The fence is the division of public property versus private property. If your hand is on the other side of the fence it is no longer on private property. Therefore you are trespassing! Look it up. LOL!!!
That's hysterical. If you want to get technical like that, he was most likely trespassing before he even got to the fence. I'm sure the fence isn't right on the property line, so it's NOT the division between public and private property. If you're in their parking lot, that's private property too.
That's what I was getting at Tim.
I seriously doubt that some cop is going to chase you down because you're walking through the parking lot at GL.

Apparently my point has been totally lost by all the experts here. My point was that laws are made for a reason. If someone trespasses that is breaking the law whether or not he partially broke it or not. It is great to have a resource such as this forum to be able to get answers to questions by the most respected lawyers in town! :-)

I was also making a point. If you consider putting your hand through a fence trespassing because its "over the boundary between public and private", you also have to say stepping onto the "private property" is trespassing too. The real point is, that coaster is literally right on Rt-43. So, putting his hand through a fence is no big deal.
Can I have you arrested for stepping off the sidewalk and into my front lawn because it's "private property"? I doubt it. You're just coming up with silly semantics.
I'm going to have to defend CoasterDad. If CF wanted you to take a picture they wouldn't have the fence there. It IS trespassing whether it's putting a hand in the fence or not. It is unlawful. The legal thing would be to take a detour to Speedway and check out the view from there.
The fence is for safety purposes, not so you can't see in.
It's not as if it's like the Maverick fence. ;)

While it's true that stepping onto someone lawn off of the sidewalk isn't grounds for arrest it is still by the law tresspassing. The real question is how wide is the public right of way on 43? Hold on let me look...
Well from the Geauga County Auditor it seems to be a 30 foot right of way from the center of the road, which puts the fence about ten feet onto Cedar Fair property. But it looks like there may be an error in that the plat wasn't updated lately. Part of the parks fence runs onto the public right of way.
(another side note is that the old GLP Rd that runs in front of the park gate isn't a publicly dedicated road, but the old road bed still is.
****edit**** looking at the legal plats for geauga lake rd the original dedication for the road was 1973 but was altered in 2003 by SFI under the name of 'Funtime Inc'. It seems that the old road was vacated in favor of the new road that runs past the Target. So for sure the new route around the XFlight location was never dedicated that i can find so no you cannot go on that "road", it isn't a public right of way. Sorry that might not be all that interesting or pertinent to the discussion, but i was just curious. Gotta love the paperless society) ***end edit***
Either way halltd has the best point of all. If you're close enough to touch the fence you're trespassing. Anyway, I can't see the park flipping out about someone near the fence, after all it's sort of an implication that you're fine on that side of the fence... as long as you stay on that side of the fence.
Now walking through the parking lot would gain the attention at least of the park security and probably the county sheriff should they pass by. First of all you would have to jump a fence, second they have various property in the parking lots (albeit less than highly valuable to most people) and thirdly they just don't want the possibility of someone causing problems of one sort or another.
On the other hand security may be asleep in their little booth.

I took this picture from 1/2 way down that road. It was pretty cold, there wasn't any security coming out that day to say, hey, you can't take that picture.
I think they use common sense most of the time and if the person looks harmless or isn't going to cause any trouble, I doubt they're going to go looking for confrontations. Although if I remember correctly, I look like a "thug". ;)

Not, that I want to extend this conversation any more... But, Cops And Security have both seen me on the proporty taking pictures on multiple occasions. They never even gave me a second look. I would guess that's because I was just taking Pictures.
