Unemployment appeals

Hey i worked the 2011 season and started recieving unemployment benefits this june, but cedar point has been making appeals against it. The first appeal i won, but now they want a phone hearing. Has this happened to anyone?

Unfortunately I went through this with CP back in 2003. I won the appeal and CP got a phone hearing which they won. I appealed that and got a second hearing which they also won. I ended up having to pay back the benefits that I made.

How long did you work that season though? I was told by the unemployment office that i qualify under the guidelines for seasonal benefits. I was there 5/02/11-11/04/11.

I worked from early April till end of August.

Oh ok i was there for 6months and had a ton of hours. The unemployment office said that period of time qualifys for benefits.

I worked till my process out date, i wasnt let go or quit.

You worked a seasonal position and for a contracted period of time. CP will win these appeals.

I can't give you a lot of details but there have been, and are, circumstances whereby a seasonal employee at Cedar Point can claim unemployment benefits and receive them.

Yea i did and technically thats due to a lack of work cause no work was left for me, and i stayed till the end of work crew. So i technically win that arguement. As far as the seasonal i qualify cause of the amount i made and i was there preseason and post.

As I said, unless there have been significant changes (and I'm not saying that couldn't be the case) then I know for a fact that unemployment cases were won by seasonals in the past. There are a number of mitigating factors. Might be best to consult an unemployment attorney but of course that could cost you and you would need to weigh the benefits of doing so.

Your situation is differnt from mine...I guess it seems possible but not something I would waste my time with.

Not even at Castaway Bay? I think that is how they get around paying unemployment now because they do offer year-round work at Castaway Bay for seasonals who want to continue working. That is why they post signs for working there at the end of the season.

And there are plenty of jobs out there.. no matter if it is one that you prefer to not work.

So you want to intentionally work a seasonal job and then let the government pay you for doing nothing after that? You think that's OK?

Applying for unemployment from a seasonal position is pretty shady. I've been on unemployment in the past, and to me, mooching off of fellow taxpayers is not something I feel too proud of. Was I entitled to those benefits? Yes. But it still doesn't feel good getting money from the government just for filling out a form once a week and sending out resumes.

If you are working at Cedar Point while unemployed from a full time position, and are simply re-applying for benefits while you search for a new job, I don't think you should have a problem with getting benefits.

When I was most recently unemployed, I worked part time, with full time hours seasonally. When my hours were cut back down to part time, I simply had to report this to the ODJFS so that my claim could be restarted. The paperwork was not fun (reporting wages weekly when you got paid bi-weekly is a pain when you can't simply go off of a pay-stub), but it feels good to know you are working part-time at a low paying job while searching for work in your field.

Anyway, good luck with trying to win against to the ODJFS. I'm not going to share my experiences with ODJFS appeals on this forum, but I will simply say this: It is much better to be underemployed than it is to collect benefits paid for by taxpayers without making even an effort to work!

What I find interesting is that the time it took to ask this ask the question and then debate it, you could have spent filling out another application.
