Looks like the court reversed the previous decision as far as his re employment status, but it is being sent back to the trial court, which means it isn't over yet.

All I really knew was that him and Kinzel got into some sort of argument in a phone conversation, and that he either resigned, or got fired.
I've heard several different stories but the bottom line is that nobody really knows what happened other than Jack and Dick. I'm more inclined to believe Jack given the final five years or so of Dick's tenure but even then it is just a crap shoot.

I believe Dick's version was that Falfas said something to the effect of, "maybe I should just resign". Jack's version was that Kinzel said somethign to the effect of, "don't come in tomorrow...you're fired."
I was hearing rumors at the end of Dick's tenure that people suspected he might be showing signs of early onset alzheimers. That certainly was never bantied about publicly so who knows if that is true. Some of his actions in the final years certainly were questionable but that doesn't mean a whole lot.

I know Mr. Falfas and some of his family on a personal level, so my feelings are a little biased in favoring his return to Cedar Fair. But I never really knew too much about Cedar Fair when he was COO, so I don't really know the benefits or cons of his return to the company.
Like I said, this isn't over yet. Cedar Fair still has the option of appealing this decision. The likely hood of a lower court overturning an appeals court decision is not good tho, as that would be just about a guaranteed trip to the Superior court. The Board of Directors just might throw in the towel on this.
I don't think he really wants his job back. I think he is just bitter. In the long run after costing CP lots of legal fees and other bills, Jack will most likely withdraw his lawsuit.

Or do they pay him for back pay up until this point and then negotiate a severance package?

If you were in Jack's position, wouldn't you be bitter too? But, I don't think bitterness is driving this. He feels he was wronged and there is a pretty good chance he was. The Board of Directors didn't have a backbone to deal with this and so now the company is suffering as a result. If there is blame to be placed then it is on the Board in my opinion.
The Board let Dick run the show for years with very little accountability. As evidenced by the final 5 years they were negligent in their fiduciary responsibilty as far as I'm concerned and that isn't Falfas' problem in my mind.
Now, that isn't to say that I think Jack will be or should be reinstated. There is going to be a heavy financial settlement, to be sure, but in all of this I can say it isn't Ouimet's fault either and as the new guy in charge I don't know why he should be saddled with someone he didn't choose for a position.

Why would he withdraw a lawsuit if he is winning? I agree with the other post. He may not even want his job back but it will mean a bigger pay day later.
He didn't cost CF lots of legal fees, the BOD did in their handling of the situation, and it goes a lot farther back than the incident that resulted in this action. Like Chief said, the BOD rubber stamped everything that Kinzel did, and it's not the first time that his actions cost the company a lot of money.
Unless something has changed, I believe Dick is still on the BOD. I doubt they will give up as long as Dick is there.

Which would be foolish and unproffesional on their part. If I still was a unit holder (dumped it after this debacle) I'd raise some hell and tell them to just settle it.
I'm pretty sure that the BOD are tired of the games that Dick has played in this situation and will vote to settle this once and for all.
