Riders Injured On TTD, Suing...

I guess these people had a reasonable expectation of not being hit by flying metal, but they need to suck it up. Their injuries were minor and CP did what was reasonable based on the severity of their injuries. Their doctor's bills surely would have been taken care of it they'd sought treatment at the time, and that should have been enough.

So, welcome to America: where half of the people are happy to trade away their integrity for some quick cash.

I agree with CEDAR POINT IS #1 here. Cedar Point should have gone above and beyond to make these kids happy. They were injuried on one of their rides and it was NOT the kids fault. The injuries were not due to rider actions. Cedar Point does have a responsibility to make sure their rides are safe not some of the time but all the time.

Cedar Point should have offered free passes to each. It seems to me like Cedar Point is slipping in the customer service department over the past few years. Heck, look at Disney, my Mother wrote Disney a letter saying how rude a cast member was to us during our last visit. Disney ended up mailing us four, one day, complimentary park hopper passes. Did they need to do this? Of course not! We were already back home for a month, and didn't expect to get anything from Disney. But guess what? They went above and beyond what we thought they would and when we got the tickets my Mom said, "Thats Disney for you." The bitter taste in our mouths' were gone. Cedar Point should have done the same.

I think most of you have no idea about what went down that day. If these are the same people that they interviewed on WEWS when it happened, they went on with their day at the park. Pain and suffering my ass.

IMO they don't have much of a case. If you read the back of you ticket or season pass it states "Pass (ticket) holder assumes all risk of personal injury, loss or damage of any property." By purchasing a ticket or a season you enter into a legal contract. Although people do not expect to get hurt, they are a guest on private property.. IF all matainence record show that the ride was safe at the last inspection, then there should be no case.Also, people knew at the time that the ride was having problems and that there were problems in the past with the cable. Therefore when they borded the ride they knew that something may go wrong. NOW I'm just waiting for the suit agains Intimin.

I completely agree with Jeff, why sit here and argue about what the park did, should have, or didn't do. None of us know all of the information, including myself, so as far as I'm concerned this thread should be shut down.

I don't know why people have to sue in this case for so much too. I mean this is really going to hurt Cedar Point. I hope they'll be alright. I mean I care about the riders, but do we really need to sue? I mean that's a lot of money, and Cedar Point won't be able to finish MaXair losing that much money.

Why, I find it fun on how much we side with Cedar Point. With all the articles I read about the incedent they all lead up to the fact that they were fine when they got off and CP did what they had to do. Though I'd like to see how CP will deal with this though. This was their first time a ride cause enough of an injury to make headlines. Could've been the fact it was on the tallest and fastest coaster too.

$50,000 will not destroy CP, I hope I can make that clear. Their reputation is more at risk than anything.

Just watching the video of the kids seemed a little.....odd. Not to be mean or accusive but, Why would they sue now of all times. It's like they just all of sudden decided to do this.

But I could be wrong.

It just seems fishy to me.

All I know is about two years back my daughter and her friend went on Mantis and the restraint let loose and she was held in by the seat belt and when she got off the ride she was hysterical/shaking/freaking out as she was young and just tall enough to ride.

CP went out of their way to comfort her and even gave our family return tickets for another day and we never expected or asked for anything.

That is how I remember CP being back in the day. The fact that they went out of their way to care made me love the place even more than I did when I first walked through the gate that day.

Where are these kids parents? Do they not teach any morals to them to not lie or exaggerate?

I could see if they lost an eye or something then they could claim pain and suffering.

If it had been me who was hit with metal I think I would have been terrified that maybe the ride would jump the track up top but that is because I don't understand how many safety features are in place. Once we made it over I would have been so thankful I didn't die I would have kissed the ground and Intamin, lol.

The only reason I said about giving the kids return tickets is because that was my experience with CP and it just was a sweet and touching thing for them to do when they did that for my daughter. I told everyone about what happened and how sweet the folks at CP were for treating her so great.

If the "kids" did indeed stay the rest of the day then they for sure are milking this and I hope CP has them on camera somewhere as proof of them staying and "enjoying the rest of their day".

What did happen with the guy on the Antique Cars? I hope he got his butt laughed out of court. I couldn't find any updates on the web anywhere.

If they've been going through "pain", they would of done something a long time ago.
Now I'm not a doctor, but I never heard of minor wounds that start causing pain and suffering months and months after they are inflicted.
I guessed they just wanted to indure the "pain" until it was so unbearable that they decided to sue to make it go away. ;)

In reality it is probably their broke arse parents who are pushing this.

I don't know too many children/teenagers who think that way.

I will also bet they had lawyers calling them or showing up at their door the very next day.

You know how THEY are. I had a guy rear-end me and by the afternoon I had an attorneys office calling me and asking me if I was okay.

That doesn't mean jack. You ride something with the reasonable assurance that it's not going to kill you or harm you.

If in fact they don't have a case, it would be because they managed to hang out at the park and refuse treatment... something I don't think anyone enduring "pain and suffering" would do.

I have a theory on this, based completely on speculation put together from things I've heard. This is a made up story, but it could have happened this way:

The kids got very minor injuries, nothing more then some mosquito bite size welts, if that much. They refused treatment, because they really were not hurt, and continued to go on the rides for the rest of the day.

When they returned home, their mom/dad realized they could milk this some and encouraged the kids to fake some pain and suffering to the news media in preparation for a law suit. Mom/dad are using the kids to get on the gravy train.

I think it is reasonable expectation to not get hit by flying shards of metal. Nowhere on the ticket does it say that if something should harm you, Cedar Point is absolved of all resposibility. The cable was an on-going problem and should have been addressed in a better way.

Wouldn't they need some sort of doctors report for their testimony? And if they refused to go to the Hospital, they wouldnt have one know would they. It's not like they can just say "we were hurt badly" and not have anything to back it up.

They're presenting a bad case with poor evidense.

I think I remember seeing pictures of the guys after the accident that showed some small cuts to the face and arms.

I think if it happened to adults it would be a totally different story. Even though this shouldn't be a 50K lawsuit, CP should have been a litte more careful. I wonder if CP even said, "hey kids why don't you call your parents and let them know what happened first".

I would sue for a limited edition Tshirt that says..."I survived TTD".

I was on TTD and I had a bad expierence. Do I want a cookie? No. I move on and rode it agien. If you want to know what happened read on. I was a blonde and somehow my foot got stuck where the T-bar thing is and we were about to launch. Luckly they stoped just before the damn thing launched. If the thing had launched well my leg would be diffrent.lol There was nothing to sue about but the point is move on and get yourself a cookie.

That's why parks carry liability insurance to cover them in cases like this. I can just imagine a personal injury lawyer with dollar signs in his eyes after talking to one of these kids that were hurt on this ride.

Was anyone actually there that day that can maybe tell us a better story than the media? I was there that morning, but I left. I wish I had been there, although it might have seemed a little scary at the time.
