The women actually took action right after the incident occurred. It's not uncommon for lawsuits such as this to stretch over a long period of time.

Since the suit was against Six Flags, I'm sure Cedar Fair wasn't even envolved.

Cedar Fair would want to be conscience of the case etc., as they don't want to have a similar incident occur under their ownership.

I realize that, what I was refering to, but which I guess no one mentioned, was that shortly afterwards a girl was injured under the same circumstances. I meant that they didn't do anything after the first accident, it took until after the second one before they took any action on the problem.

According to the article in the paper about this matter, Six Flags did take action, but their actions and precautions were very half-hearted. For example, SF wanted to put mulch in the area instead of rocks, but instead the employees just put a layer of mulch over the rocks. The article also said that SF tried to increase patrolling around the are.

I recall back in the late 80's being called out to the Double Loop because someone had been injured by what they thought was a rock thrown from the midway. This should not have come as a surprise to anyone involved with the operation of the park.

So a guest can throw a rock at another guest and the park is responsible? Crazy....

If it happened more than a few times, it was documented, and nothing reasonable was done to prevent it then yes...the park is responsible.
I'll give you another example. If a hotel puts video cameras in a couple of wings of their hotel but someone gets raped in the hallway of a wing that didn't have cameras, the hotel will be held responsible. There is a "duty of care" and, while that may sometimes be vague I think the standard applies when a park knew of a hazard and didn't make significant changes to affect a safer outcome.
