Insurance won't cover Vertigo

Cedar Fair's insurance won't pay the whole $7.2 million for construction, removal, and loss revenues of Vertigo.

Well, I guess we finally have an official word on the cause of the collapse, "vortex shedding". That seemed to be a popular choice back when we were discussing what could have caused the collapse.

I don't see how Cedar Fair can make a claim on the Vertigo at Knotts. After all, there was no loss. If I dismantle my car and try to collect from the insurance company, will they pay? Of course not. This seems to be much more of a product liability / product warantee issue with S&S rather than an insurance issue. I think the insurance company is correct in only paying for the cost to repair the ride.

I think that S&S should pay for the losses. If a car manufacturer releases a brand new model, and something goes horribly wrong because of a defect, they are expected to fix the problem at their expense. In the case of an amusement ride, people don't just forget about a catastrophic failrue, so S&S should pay for all the rides.

USF&G claimed this ride was repairable. Can you believe that? I say CF should reassemble it and line up a few dozen wing-tipped lawyers and their families. Wheeee!

The ride was repairable, just replace the tower which failed.

Moreover, there is a good example that the rides (especially the Knott's model) could be fixed. One might be able to make an arguement that the CP ride needed to go, but since SFMM is opening the same ride with a "retrofit" that corrects the original problem, the same could have been done for the Knott's ride.

And as for public perception, the prevailing 'wisdom' here is that people in So Cal dont even know that CP exists, so why would they know about an accident on a similar ride?

Repairable? Sure! But my point is this...if those hypocrites were in the GP's shoes, they'd be a lot less likely to get all technical about it.

Unless the media made it known, the GP wouldn't know, correct.... Knott's pieces to vertigo are still on property. Why put up the ride though when the BBQ makes more profit.

It had nothing to do with who knew about it. It had to do with the fact that if the ride were to fail with people on it and they got hurt or died, the company would have a negligence suit so far up their ass that the cost would be far worse, to say nothing of their reputation.

The only thing I don't understand is that if Cedar Point is self-insured (which it is), who makes the decisions as to what that insurance will and won't cover.
