Hands Up against the law

On all the roller coasters all the signs, speils, and ops say keep arms down at all times. I was wonder since the law says you must follow all instructions given by operaters is putting your hands up on a ride against the law. Apparently if this is true it's not enforce, because quite a few people are breaking the law.

I keep my hands up. You're right no one says anything, so if it was really "against the law", I think they would do something about it.

Well, it isn't like there are people or cameras posted all along the circuit to spy on you to see if your hands are up or not.

I wouldn't be surprised though if, come next season, you won't be able to buy an on-ride photo if you have your hands up in the picture. They will probably block those like they do now with people who flash or give the bird.

Well they already have auto-spiels longer than the dispatch interval, and recordings on the lift you can't hear if you're actually on the ride, so why not?

It is just a hunch on my part. If I am a lawyer suing a park and I am trying to prove that the park had contributed to the negligence that led to my clients injury, the first thing I would do is go to the photo booth and get those pictures.

Then I could say that the park not only ignores the behavior but they profit from it. Case is made.

Well, as Jeff pointed out, it wouldn't surprise me either, but in consideration of that, the park had better start adding airgates to rides like Wildcat and Skyride, just cover their butts in the case of a lawsuit...right? Blocking those pictures will take away from what I would say 85-90% of their profits on those pictures. It would also make for a large percentage of some very angry people, and on top of that would almost completely defeat the purpose of taking people's pictures, because there won't be any to purchase. Period.

I am not disagreeing with you. I am just saying that a Pandora's Box is being opened here and parks that say they have a "No Hands Up" policy are being pretty hypocritical if they turn around and sell thousands of on-ride photos with guests flailing their arms.

I would also say that if parks have airgates at some coasters and not others then they are going to have a tough time in court should someone get injured at a coaster without the gates. The prosecution would almost certainly claim that the park was negligent because they forsaw the potential for injury on ride A but did nothing about ride B.

If you want to get that specific about it, how do you classify "inside the car". The cars aren't closed, and especially on the Intamin rides with the open trains, it's hard to decide when and when your arms aren't "inside" the train. The reason this isn't bothered with too much is that nobody's safety is jeopardized by some people with their hands up, so there wouldn't be any reason to file a lawsuit to begin with.

Wow... interesting topic. I was actually talking to someone about this a few months ago. If you notice CP's advertisements never show riders with their hand up. Rides are made with the clearance for hands to be up, but its a "protect ourselves" policy to tell riders not to. They really can't do a lot to get everyone to keep their hands down for the whole ride, but they don't "encourage" the behavior.
If I knew I wouldn't be able to buy my picture if my hands were up, I think I would put my hands down just for the picture... Do you think others would do the same?

Yeah, I do agree that CP just does say this for legal reasons only. If you get injured for doing this than the spiel, "hold on to your grab bars at all times" and "you ride at your own risk" is a hard case to beat.

Well actually there are survelence cameras on the top of all lift hills which the ride op. views at all times. This is why rides are sometimes shut down on the top of the lift hills when people are standing up ect. Wow this has become a real intresting post!

The 'hands-up' rule nitpicking is getting pretty silly. Most often it's a lame excuse foisted by those who break the 'no-photos or videotaping' rule. But I pose this question...

Since the train has no canopy over my head, does that mean every part of my body above the torso violates park rules too? So what difference does it make if I'm a slightly 'taller' person with my extended arms?

Yeah CoastaPlaya, I think the torso does violate rules. They should censor everyone's picture! Good thing we have people who make such thought provoking posts to try to defend putting their hands up on a ride. I think that people understand the concept of "keeping arms inside the train".
Phillip, look up the word "sarcastic" in the dictionary and then apologize to Playa.

Playa was taking the abusurdity of this no-hands-up rule to the next level to show just how stupid it is.

I don't think they should say you can't put your hands up but if they do intend that to be a rule than my only point in all of this is they better stop making money off of people who buy pictures of themselves with their hands up.

The question was posed as food for thought...which, by definition, would kinda require THINKING as opposed to simply reacting. You know, like a dicsussion topic or something.
