Jeff, not to be a thorn in your side, but it does matter if it's media that is free or pay. You'd win for something available as a club member, since you can claim loss of profits due to people not paying for the memberships. Are you also implying that you would sue if the low-res video was put on Kazaa? You may be able to sue for someone for that, but you would almost certainly lose, since you could not prove any damages occured. You did not lose money, no one lost money...unless people start charging for it. The ad revenue lost is a dead end argument, since the actual pop-up with the video can be linked directly, and contains no ads.
Cloning the site is a different entity entirely: You lose ad revenue, and someone else could gain it. However, someone is within their legal rights to clone the site to store locally, as long as they don't publicly put it out for use and personal or professional gain.

What matters is there's copyright attached to it, and the copyright holder has the right to dictate how their work is distributed.
Period.
And since Jeff has rights to distribute it (and I'm imagining it's in whatever fashion he sees fit) then the same rights occur with him, with the exception that he cannot change the material in the video unless allowed to do so by Badnitrus, as Badnitrus is the copyright holder.

I'm sorry, how many years have you dealt with intellectual property law? It has been a part of my expertise for more than a decade. Material gain has zero to do with copyright, period. Read the case law. You have copyright, and the right to enforce it, the very moment any media is created. It's that simple. It's IP law 101.
And yes, Keith is the copyright holder, and has granted license to me to distribute it in return for free hosting.

What would the stance be if a download mirror was offered at no charge, with no bandwidth concerns? Providing the copyright owner gave said permission for distribution of the Hi-Res version?
At either rate, I am still happy to see the Low-Res version, and am sure I will see the Hi-Res version eventually....
